Three disqualifiers. Each one sitting above the asset. Each one invisible if you start the analysis at the wrong level.

Disqualifier One · The Macro Layer · Spain, Germany, England

The annual real estate outlooks circulating across Spain, Germany, and England were written when the ECB was expected to hold rates at 2% or cut further. The ECB hiked on 11 June for the first time since 2023. The demand-side assumptions embedded in those documents, Euribor trajectory, credit availability, affordability improvement, were built on a rate environment that no longer exists. The macro layer moved and the thesis did not. That gap is where capital gets misallocated.

Disqualifier Two · The Jurisdiction Layer · New Zealand

The New Zealand Overseas Investment Act amendment was reported almost universally as a foreign buyer ban being lifted. New Zealand's own chief property economist corrected that framing directly. "It's not an easing of the foreign buyer ban. The foreign buyer ban is as it's always been." The amendment opened a narrow pathway for one visa category above NZ$5 million, approximately 1% of the housing stock. A thesis built on the headline rather than the legislation was a thesis built on a misread. The jurisdiction layer was the disqualifier, and it was readable before anyone committed capital.

Disqualifier Three · The Exit Liquidity Layer · UAE

The off-plan payment plan structure in Dubai insulates the buyer from credit market conditions in the short term, but it does not insulate the developer. Construction finance, land acquisition debt, and refinancing requirements all sit directly downstream of the bond market. In late March 2026, six sukuk issued by Binghatti and Omniyat were trading at over 1,000 basis points above the risk-free rate. The transaction data was showing resilience. The credit market was showing developer stress. The exit liquidity layer was visible in the bond market months before it would appear in the physical market.

Three layers, three mechanisms, and one common failure mode. The analysis started below where the risk actually lived.

The question worth asking before the next commitment is at which layer this thesis breaks, and whether you have looked there.
